If you think going to prison and creating a bad image for yourself for not paying your dues on time is not a reason for you to be prisoned be imprisoned behind bars, think again. This article from Pinoy Entrepreneur is an awakening to the legal process that awaits those who are intentionally not paying their debts.</p>
<blockquote><p>
Of course, you can&#8217;t be imprisoned simply because of debts. The title is merely meant to get your attention and to highlight the fact that certain collection agencies threaten to file criminal cases against debtors who fail to pay. The prohibition against imprisonment for a debt is a basic right enshrined in no less than the <a href="http://www.jlp-law.com/content.php?id=1278&amp;subId=Constitution" target="_blank">Constitution</a>: &#8220;No person shall be imprisoned for debt or non-payment of a poll tax.&#8221; In other words, no one could be compelled to pay a debt under pain of criminal sanctions (estafa is a different matter). No one could also substitute the payment of debt through imprisonment or other criminal penalties.<br />
<span id="more-1470"></span><strong>Bouncing checks</strong>. Certain laws, including <a href="http://pinoy-business.com/content/view/14/90/">Bouncing Checks Law (BP 22)</a>,  have been questioned as a violation of this right. However, it&#8217;s not the non-payment of an obligation which this law punishes. The law isn&#8217;t designed to coerce a debtor to pay his debt. The thrust of the law is to prohibit, under pain of penal sanctions, the making of worthless checks and putting them in circulation. Checks have become widely accepted as a medium of payment in trade and commerce, and if the confidence in checks is shaken,  the usefulness of checks as currency substitutes would be greatly diminished. When the question was resolved in 1986, it had been reported that the approximate value of bouncing checks per day was close to 200 Million Pesos, thereafter averaging between P50 to P80 Million a day. <em>(Lozano vs. Martinez)</em></p>
<p><strong>Trust receipts</strong>. The same argument was raised against the <a href="http://pinoy-business.com/content/view/736/105/">Trust Receipts Law</a> (PD 115), which is a declaration by the legislative authority that, as a matter of public policy, the failure of a person to turn over the proceeds of the sale of goods covered by a trust receipt or to return said goods if not sold is a public nuisance to be abated by the imposition of penal sanctions. It punishes the dishonesty and abuse of confidence in the handling of money or goods to the prejudice of another. The law does not seek to enforce payment of a loan. <em>(Tiomico vs. CA)</em></p>
<p><strong>Credit cards</strong>. Under the <a href="http://pinoy-business.com/content/view/155/90/">Access Devices Regulation Act of 1998</a> (RA. 8484), anyone who obtains &#8220;money or anything of value through the use of an access device, with intent to defraud or with intent to gain and fleeing thereafter&#8221; is criminally liable, punishable with a fine and imprisonment. That law also provides that a cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least 90 days and is more than P10,000.00, shall be <em>prima facie</em> presumed to have used his credit card with intent to defraud.&#8221; We are still waiting for the test case on this.</p></blockquote>

<p>Unless you intend to give your money away to strangers and to your friends then don’t read this blog. As between friendship and relationships- although there’s trust involved its best that the debt or money borrowed between friends or relationships is secure. Secure means there’s evidence of the debt, its not floating around in the air. I know that some people can live with a person’s palabra de honor or a person’s word- but its best that a debt is secured by something written in paper. </p>
<p> How does one secure a debt transaction?</p>
<p>1. <strong>Promissory Note</strong>- This is simply a piece of paper with the words “I promise to pay Mr. Smith the amount of P1,000.00”- and you have to include the date when that amount is due and where he or she will pay. Would a receipt of an amount suffice- well if its an exchange of money for goods yes- but in case of debt no, a receipt only shows the person got money it does not mean he or she is indebted. Some people just jot down the amount put the date on it- that’s also a no-no if you want that debt collected later on.</p>
<p><span id="more-1461"></span>If you want the loan to bear interest then put it in the promissory note. Otherwise, there’s no stipulation as to whether the loan will earn interest or not. </p>
<p>2. <strong>Checks</strong>- If the other person, the debtor has a checking account have him issue a check for the amount borrowed- with the date on the check being the date when the loan matures. Note that the debtor or creditor might agree not to deposit that check but if you’re the creditor I’d advise you to deposit the check on the due date and let the check bounce for fear of the check becoming stale later on. </p>
<p>3. <strong>Real Estate Mortgage</strong>- you can have a lawyer prepare this for you its document stating that a piece of property whether titled or not is being made subject as collateral for the loan. This applies when the money borrowed is really huge but it does not mean automatically that you as creditor become the owner of the property if the debtor does not pay- you still have to foreclose the mortgage or sue the debtor for the loan.</p>
<p>4. <strong>Loan Contract</strong>- prepare a loan contract through a lawyer if you want it clearly stating all the terms and conditions- (a) duration of the loan (b) interest or penalties if any (c) and the date when the loan would be due and demandable. </p>
<p> Can you bind another person for the loan? Yes- he could be a guarantor or a co-maker.</p>

<p>The<strong> International League of Peoples&#8217; Struggle Working Group</strong> on Teachers, Researchers, and other Education Personnel invites academics, scholars, researchers, education and social activists and progressive intellectuals to an international conference on &#8220;Education, Imperialism, and Resistance,&#8221; to be held in Shih Hsin University, Taipei, Taiwan on August 10-11, 2009. It will be hosted by the International Center for Taiwan Social Studies and Taiwan: A Radical Quarterly in Social Studies.</p>
<p>The conference aims to bring together academics and social activists to put forward a progressive critique of imperialism and education.</p>
<p><span id="more-1437"></span> Imperialism is at the root of untold suffering for billions of people throughout the world. Imperialist banks and corporations reap huge profits from the exploitation of working people even as the world economy is racked by crises, the gap between rich and poor countries widens, hundreds of millions are thrown into unemployment, billions are kept in poverty, and environmental destruction proceeds unabated. The imperialist countries, led by the United States, wage wars of aggression to control valuable markets and resources and suppress revolutionary movements. All over the world, imperialism intensifies the oppression of women, exacerbates racial and ethnic conflicts, and incites discrimination against migrants.</p>
<p>In the guise of neoliberal globalization, imperialism is having a devastating impact on education. Drastic cuts in public spending for education have become the norm. Teachers, researchers, and other education personnel suffer deteriorating standards of living as salaries fail to keep up with rising costs. Large numbers are being laid off as governments close down schools and universities deemed inefficient. As education becomes the flashpoint for popular struggles, schools and universities are increasingly subjected to state repression.<br />
Imperialism exercises an ever-tightening grip on education. The WTO&#8217;s General Agreement on Trade in Services (GATS) has placed liberalization of the so-called education market and the privatization of education on the agenda of future negotiations, along with other basic social services. Teaching and research are to an unprecedented extent driven and defined by corporate interests.<br />
Imperialist control of education is a key element in imperialist domination of culture as a whole. U.S. imperialism, in particular, makes full use of the means at its disposal—chiefly its huge monopolies in mass media—to shape world public opinion according to its interests. Monopolies have increasing influence over curricula, education programs, institutional organization, and research agendas.<br />
Struggle over knowledge and research is a key aspect of struggles against imperialism.  On the one hand, imperialist domination of education and research is used to undermine people&#8217;s struggles. On the other, a critique of imperialist ideology can be an important tool in the struggle for radical structural change. Throughout the world today, education workers respond to imperialist globalization through solidarity and struggle to defend their rights and welfare, the people&#8217;s right to education, and advance the struggle for a more just and humane future for all.</p>
<p>Participants to the conference are invited to present a critique of any aspect of imperialism and education including access to education, education sector reforms on neoliberal lines, right to education and livelihood, the political economy of education, the politics and theories of knowledge production and research, the impact of privatization and liberalization on educators and students and the impacts of education sector reforms on societies. We encourage interdisciplinary approaches to these concerns.</p>
<p>Individual papers and panel presentations on the general theme are most welcome.  Specific papers on any of the following themes may be submitted for consideration. Tracks correspond to the possible organization of the plenary sessions.  The program committee reserves the right to merge, reschedule or reassign topics, based on suggestions and interest from the participants.</p>

<p>Participants may also form panels and are urged to submit the corresponding proposals. Panel organizers will be responsible for organizing panels put forth by them.</p>
<p>The organizing committee will review submissions and decide on the final schedule of presentations. Selected papers will be considered for publication, after peer review.</p>
<p>Papers should be prepared and presented in English. There is no page limit but contributors are encouraged to limit their paper to less than or equal to 20 pages (A4 paper, font 12, double-spaced) including the cover page, abstract, text, references, tables and figures. The format should follow standard academic styles.</p>
